At WealthCentral , LLC (“WealthCentral”, “we,” “us,” or “our”), data privacy is important to us. This Privacy Policy (“Policy”) explains how we collect, use, and disclose personal data collected through our websites, applications, products, and other services (collectively, the “Services”) for our own purposes. We also process personal data on behalf of our customers subject to a written contract. We do not control the data processing or protection practices of our customers, which may differ from those set out in this Policy.
By using our Services, you acknowledge and consent to the practices described in this Privacy/Security Policy, as well as the additional terms in our Subscription Agreement.
Collection of Personal Data
We may collect personal data about you when you provide it to us directly, automatically through your use of the Services, or from third parties, as detailed below.
Information you provide to us:
We collect information directly from you, such as when you sign up for an account, use our Services, or contact us. The types of information we may collect from you include:
• Identifiers, such as your name, address, telephone number, email address, or user name.
• Commercial information, such as details about your use of the Services or interest in our offerings.
Information we collect automatically:
Our servers automatically record information about your interaction with our Services (“log data”), including information that your browser sends whenever you visit a website or your mobile app sends when you use it to access the Service. This log data may include, among other things:
• Identifiers, such as your Internet Protocol address, unique device identifiers, cookie identifiers, or usernames.
• Internet or other electronic network activity information, such as the address of the web page you were visiting before you came to the Service, browser type and settings, the date and time of your request, and how you used the Service.
Depending on how you access the Service, we may use “cookies” (a small text file sent by your computer each time you visit our website, unique to your WealthCentral account or your browser) or similar technologies to record log data as well as Uniform Resource Locators (URLs). When we use cookies, we may use “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them). For example, we may use cookies to store your WealthCentral settings so you don’t have to set them up every time you visit our website.
In addition to log data, we also may collect information about the device you are using the Service on, including what type of device it is, what operating system you are using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you are using and its settings. For example, different types of information are available depending on whether you are using a Mac or a PC, or an iPhone or an Android phone. To learn more about what information your device makes available to us, please also check the policies of your device manufacturer or software provider.
The Services do not respond to “do not track” signals sent by Internet browsers.
Information from third parties:
We receive and process information from our affiliates and from third-party sources, including employers, business partners, business contact databases, enrichment services, channel partners (e.g., resellers), marketing service providers, third-party data aggregators, and social networking services and platforms (e.g., LinkedIn and Facebook). We also receive information from publicly available sources and licensors. The categories of personal data we collect from these sources include:
• Identifiers, such as names, phone numbers, and email addresses.
• Professional information, such as occupations, industries, professional licenses, work experience and employment histories, and other qualifications.
• Commercial information, such as events you have attended or activities you have participated in.
• Inferences, such as regarding usage information and your preferences, behaviors, and other attributes.
In accordance with applicable law, we may combine your personal data with information we collect from other parties to help keep our databases current and accurate, and to provide you with more relevant content, experiences, applications, and other offerings.
Anonymous Information:
We may create Anonymous Information records from account information or Client Information. “Anonymous Information” is information that is not associated with or linked to Client Information and does not permit the identification of individual clients or accounts. Generally, we aggregate this information and use it in statistical analysis to help us analyze patterns in the use of the Service. We may use or disclose Anonymous Information in any way (including providing benchmarking data or analysis for the users of the Service) and we reserve the right to use and disclose Anonymous Information to our partners, advertisers and other third parties in our discretion. We will not attempt to re-identify Anonymous Information.
Purposes for Processing Personal Data
We use your personal data for the following purposes:
• To provide Services to you, including to create and maintain your account(s), verify your identity, or provide customer service.
• To respond to your inquiries and send you information, including technical notices, updates, alerts, or other messages related to our Services or our relationship with you or your clients.
• To send you information about products and services that may be of interest to you and to provide interactive or personalized elements on the Services.
• To maintain and improve our Services, including to run analytics, assess the quality of our services, enhance our offerings, and other related internal business purposes.
• To maintain and improve the security of our systems, including debugging to identify and repair errors and to ensure the security and integrity of our operations.
• To perform internal operations necessary to run our business, such as to conduct audits or prevent, detect, or investigate fraud, or in order to receive services from our vendors, service providers, and business partners.
• To perform analytics and market research.
• To improve our advertising and marketing mechanisms.
• For legal purposes, such as to respond to requests from courts, regulators, or law enforcement; comply with applicable laws; enforce our policies or agreements; or protect, defend, or enforce our rights, privacy, safety, or property, and/or that of you or others.
• As part of the consideration, negotiation, completion of a business transaction, including investments or the sale, merger, consolidation, acquisition, change in control, transfer of substantial assets, bankruptcy, or reorganization, and any subsequent integration.
• For any other purposes of which you are notified, and if applicable, provide consent.
Disclosures of Personal Data
We may provide your information as well as information about your clients (“Client Information”) to third party service providers who work on behalf of, or with us, but solely to the extent necessary for us to provide some of the services and features of WealthCentral and/or to help us communicate with you (such persons, “Service Providers”). Examples of such services include sending email, hosting our applications, storing data, arranging for the receipt of Client Information from financial institutions, funds custodians or persons authorized to transfer such account information, analyzing data, and providing customer service. 33
We may also disclose your personal data for the purposes described above as follows:
• We may disclose information about you to members of our corporate family, including for their marketing and advertising purposes, in accordance with applicable law.
• We disclose personal data if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by courts or government agencies to meet regulatory or law enforcement requirements.
• We disclose personal data if we believe that your actions are inconsistent with our terms of use or other policies; if we believe that you have violated the law; or if we believe it is necessary to protect the rights, property, and safety of WealthCentral, our customers, the public, or others.
• We disclose personal data to our business partners and professional advisors, for example, as necessary to obtain advice or otherwise manage our business interests.
• We disclose personal data in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
• We disclose personal information when we have your consent or if you direct us to do so.
Third Party Data Collection
Some content or applications on the Services may be provided by third parties, including advertising companies, ad networks and servers, analytics companies, and application providers. These third parties may use cookies, pixels, or other tracking technologies to collect information, potentially including personal data, about your online activities over time and across different websites when you use our Services. Those third parties may provide WealthCentral with data collection, reporting, ad response measurement, or analytical information, and assist with delivery of relevant marketing messages and advertisements. The tracking technologies may also allow the third parties to deliver targeted advertisements on other web sites or on social media networks and gauge their effectiveness.
WealthCentral does not control these third-party technologies and their use is governed by the privacy policies of those third parties.
Protection of Your Personal Data
We maintain reasonable and appropriate technical, physical, and administrative safeguards designed to help protect your personal data. While we attempt to protect your personal data in our possession, no method of transmission over the Internet or security system is perfect, and we cannot promise that information about you will remain secure in all circumstances. Please exercise caution when transmitting your personal data over the Internet.
Children’s Privacy
Our Services are not designed for children under the age of 13 years. If you are a parent or legal guardian and you believe that a child has provided personal data to us without your consent, please contact us using the information below.
Changes to This Policy
We may change this Policy at any time by posting a new version on our website at WealthCentral (www.wealthcentral.com). We will provide additional notification if we make material changes to our privacy practices or as otherwise required by law.The new version will become effective on the date it is posted, which will be listed at the bottom of the page as the new Effective Date. By continuing to use the Services after the Effective Date, you consent to the updated terms.
